GIFT CARD TERMS AND CONDITIONS

The following terms and conditions (the “Terms and Conditions”) apply to any 24efitness gift card originally purchased at any participating 24efitness Fitness Club (“24efitness”) or on the 24efitness.com website (the “24efitness Gift Card”). 24efitness Gift Cards are issued by EQ Services LLC, a Virginia limited liability company ( “Issuer”). By purchasing an 24efitness Gift Card, accepting and retaining an 24efitness Gift Card or using an 24efitness Gift Card, you agree to these Terms and Conditions. 24efitness reserves the right to change, amend or terminate the Terms and Conditions of the 24efitness Gift Card program at any time with or without notice in our sole discretion.

Use of the 24efitness Gift Card

You may use the 24efitness Gift Card only to purchase eligible merchandise and pay for services at any 24efitness Fitness Club (excluding cafes), The Spa and The Shop.

Redemptions/Balances

Your use of the 24efitness Gift Card is limited to the current dollar value held on the card. You may obtain your balance by presenting your 24efitness Gift Card at any 24efitness Fitness Club. 24efitness Gift Cards may not be redeemed for cash, except to the extent required by law.

Restrictions

You may not return, resell or use any 24efitness Gift Card for any unauthorized advertising, marketing, sweepstakes or other promotional purposes.

No Expiration Date/Service Charges

The 24efitness Gift Card has no expiration date, service charges or dormancy fees.

Promotional Cards

These Terms and Conditions do not apply to gift cards or other stored value cards that are given away for free or distributed as a reward, incentive, or as part of a marketing or promotional program (“Promotional Cards”). Promotional Cards may have different terms and expiration dates to the extent permitted by applicable law.

Lost or Stolen Cards

Protect your 24efitness Gift Card as if it were cash and safeguard the 24efitness Gift Card from unauthorized use. Except where required by applicable law, neither Issuer nor 24efitness is responsible for and will not replace 24efitness Gift Cards if lost, stolen, damaged or destroyed.

Misuse of the Card

Issuer and/or 24efitness reserves the right in its discretion to suspend or terminate use of any 24efitness Gift Card if Issuer or 24efitness suspects any fraud or misuse of an 24efitness Gift Card. Issuer or 24efitness may cancel the 24efitness Gift Card at any time, without notice.

Property Rights

The consideration paid for the 24efitness Gift Card, including any unredeemed balances, is the property of the Issuer.

No Warranties

Subject to applicable law, 24efitness and Issuer make no warranties, express or implied, with respect to the 24efitness Gift Cards, including without limitation, any express or implied warranty of merchantability or fitness for a particular purpose. Neither Issuer nor 24efitness assume any responsibility for any loss of any kind arising out of your use of any 24efitness Gift Card. In the event an 24efitness Gift Card is not functional, your sole remedy and Issuer’s and 24efitness’s sole liability shall be the replacement of the 24efitness Gift Card at its then-current value.

Governing Law

The laws of the Commonwealth of Virginia govern the Card and the Terms and Conditions of this Agreement, without regard to choice of law principles.

Severability

If any one or more of the provisions of these Terms & Conditions shall be for any reason whatsoever held invalid, then such provisions shall be deemed severable from the remaining provisions and shall in no way affect the validity or enforceability of the other provisions of these Terms & Conditions.

Entire Agreement

Except as specifically stated otherwise, these Terms & Conditions set forth the entire understanding relating to the subject matter hereof, and all prior understandings, written or oral, are superseded by these Terms & Conditions.
